Part 382 - Controlled Substances and Alcohol Use and Testing

1. Controlled substance and alcohol testing, as described in Part 382, are required for all persons who operate a commercial motor vehicle and:
a. drive over 100 miles a day
b. are subject to the requirements of Part 383 (Commercial Driver License)
c. operate farm equipment in the fields
d. operate one-ton pickup trucks on public highways

2. A post accident controlled substances and alcohol test must be performed if:
a. the accident results in a vehicle being towed but the driver is not cited
b. the accident involves striking an animal on the highway
c. a state accident report is required
d. the accident results in a fatality

3. A post accident alcohol test, if required, should be performed immediately, but no longer than:
a. 32 hours following the time of the accident
b. 2 hours following the time of the accident
c. 8 hours following the time of the accident
d. there is no time limit

4. If a driver refuses to submit to a controlled substance or alcohol test:
a. The driver will be terminated from employment by that motor carrier
b. The driver will not be allowed to operate commercial motor vehicles outside a 100 mile radius
c. The driver will not be allowed to perform safety sensitive functions
d. The driver must attend AA meetings

5. No driver shall perform safety sensitive functions:
a. within 4 hours of consuming alcohol
b. if he is involved in an injury accident
c. within 8 hours of consuming alcohol
d. if he is selected for random testing
