Due to potential disruptions in fuel delivery for Oregon and the Pacific Northwest, Governor Kotek declared a state of emergency for Oregon effective November 24, 2025 (EO 25-30).
Included in the Governor's executive order is an emergency waiver for motor carriers operating in Oregon. Effective immediately, motor carriers and drivers of commercial motor vehicles delivering fuel products are providing emergency relief during an emergency under 49 CFR 390.23. Pursuant to 49 CFR 390.23(b), they are therefore exempt from the application of 49 CFR Parts 390 through 399 as those regulations apply to fuel delivery, including the driver hours of service rules in 49 CFR 395. This exemption stands during the emergency period or 14 days from the date of the initial declaration of emergency, whichever is less.
