On January 13, the U.S. Supreme Court issued a stay of the Biden Administration’s vaccine-or-test mandate for large employers. ATA cited this as a “tremendous victory on behalf of the trucking industry and workers and employers everywhere. Today's ruling by the Supreme Court validates our claim that OSHA far overstepped its authority in issuing an emergency temporary standard that would interfere with individuals’ private health care decisions.” Read more

Vaccine mandates for cross-border truck drivers start in January 2022. The United States, Canada and Mexico will all be implementing vaccine mandates for those crossing their borders, including truck drivers who have been exempt up to this point. Both Canada and Mexico plan to put their rules in place by January 15. The U.S. will follow on January 22. Here is some information to help drivers prepare:

Canada: U.S. truck drivers will need to use the ArriveCan app to verify their vaccination status. The Canadian Trucking Alliance has prepared training materials for drivers - ArriveCan FAQs, ArriveCan App Information Sheet & Instructional Video - ArriveCan App.

Mexico: Rule states that “all inbound non-immigrant foreign national travelers crossing U.S. land ports of entry or ferry terminals – whether for essential or non-essential reasons – must be fully vaccinated for COVID-19 and provide related proof of vaccination.”

Federal Motor Carrier medical card waiver extended to Feb. 28, 2022. To ensure that Commercial Motor Vehicle drivers are able to operate during the COVID-19 response, the FMCSA will continue to offer extensions on Medical Examination Certificate requirements for commercial drivers whose MEC has recently expired. FMCSA’s Emergency Declaration that was set to expire on November 30 has been extended until February 28, 2022. As before, it applies only to the transportation of certain goods, including medical supplies, vaccines, food, paper products, gasoline/fuel and other essential supplies. FMCSA has also extended the CDL and CLP waivers under certain circumstances. Details on the applicability can be found here.

Oregon Health Authority (OHA) announced that the outdoor mask mandate, which went into effect in August, has been lifted. It required masks in most outdoor settings, including at large outdoor events where physical distancing is not possible - regardless of vaccination status. OHA has not set any expectations on when the indoor portion of the mandate will be lifted.

Oregon Voluntary Organizations Active in Disasters (ORVOAD): the state chapter of the National VOAD. The VOAD consists of organizations active in disaster response throughout the state of Oregon. The VOADs role is to bring organizations together and enable them to understand each other and work together during times of disaster preparedness, response, relief and recovery.
